If this RPC was "made" before the closing of Konoha, then I have no problems with him being a Missing-Nin now.

Ah. Well, in that aspect, I highly doubt it was, as this was posted rather recently, within a few weeks, I believe.
However, in the character's defense, and not trying to be difficult, there have been a couple like cases approved since this has been posted. Only two come to mine, and both are technically Uchiha, though one is by a different name.
